O número de vagas a serem preenchidas por meio do concurso público pode passar a ser igual ao quantitativo dos respectivos cargos ou empregos públicos vagos no órgão ou entidade. É o que prevê a Proposta de Emenda à Constituição (PEC) 29/2016, que aguarda votação na Comissão de Constituição, Justiça e Cidadania (CCJ).
Caso a regra estivesse em vigor, o próximo concurso do Senado Federal, por exemplo, deveria abrir 1008 vagas, total de posições ociosas hoje na Casa, conforme dados do Portal da Transparência.
Apresentado pelo senador Paulo Paim (PT-RS), o texto também assegura a nomeação de todos os aprovados em concursos públicos dentro do número de vagas previsto no edital do certame. Assim, propõe que seja explicitada na Constituição o entendimento do Supremo Tribunal Federal (STF), que em 2011 reconheceu direito subjetivo à nomeação aos candidatos aprovados dentro do número de vagas previstas no edital.
A PEC ainda determina que o número de vagas para formação de cadastro de reserva não pode exceder a 20% dos cargos ou empregos públicos a serem preenchidos por meio do concurso público.
Outra regra trazida pelo texto se refere à abertura do concurso. A PEC veda novo certame enquanto houver candidatos aprovados em seleção anterior. Da mesma forma, veda concurso exclusivo para cadastro de reserva.
“Não raro, há brasileiros que se deslocam de outros estados para prestarem concursos públicos, despendendo recursos com cursos, inscrições, passagens e hospedagens, mas acabam não sendo nomeados no cargo ou emprego público que almejam, ainda que haja cargos não ocupados”, justifica Paim.
O relator da PEC na CCJ é o senador Ivo Cassol (PP-RO), que ainda não apresentou seu parecer.
