Justiça determina retomada das aulas na rede estadual

A justiça atendeu ao pedido do Governo do Estado e do Ministério Público Estadual, por meio da ação civil pública, para que as aulas sejam retomadas nas escolas da rede pública estadual que contam com manifestações contra a PEC 241. O secretário de Estado da Educação, Haroldo Rocha, recebeu a imprensa e anunciou a decisão judicial, na tarde desta quarta-feira (02).

“Estive visitando as escolas, dialogamos sobre o movimento e pude ver que os estudantes estão protagonizando um momento histórico. Precisamos garantir o direito de quem quer estudar, mas não vamos negar o direito de quem quer manifestar. Nesta quinta-feira (03), um conjunto de regras será esclarecido para que os diretores e a equipe escolar realizem as mediações com os estudantes e as aulas possam ser retomadas o quanto antes”, esclareceu o secretário da Educação, Haroldo Rocha.

Atualmente, 60.886 estudantes de 61 escolas da rede estadual estão com as aulas suspensas, devido às manifestações dentro das unidades de ensino.

Decisão judicial

De acordo com a decisão, todo e qualquer indivíduo que não seja aluno regular da respectiva escola ocupada deve desocupar a instituição no prazo de 24 horas. No caso de menores, os pais/responsáveis serão notificados para que compareçam a unidade escolar e seja cumprida a decisão.

A notificação pessoal dos pais/responsáveis dos menores que estejam participando da manifestação será para fins de ciência e responsabilização, para cumprimento da ordem judicial nos termos do Art. 249, do Estatuto da Criança e do Adolescente.

Além disso, o documento determina a intimação de todos os estudantes manifestantes de cada uma das unidades de ensino ocupadas, para que seja garantido de ir e vir, bem como o correto exercício da atividade educacional direcionada, devendo respeitar os espaços físicos onde são realizadas as atividades pedagógicas.

A partir do início do cumprimento da decisão fica também proibido o ingresso de novos manifestantes na unidade que não sejam alunos regulares.

Para o cumprimento da ordem judicial, a justiça determinou que as notificações devem ser realizadas com o acompanhamento do Conselho Tutelar, da equipe pedagógica e fiscalizada pelo Ministério Público Estadual.
