O Tribunal de Justiça informou que foi suspenso o expediente forense nas comarcas de Vitória, Serra, Vila Velha, Cariacica e Viana. O expediente na sede do TJES está mantido. A Justiça Federal e do Trabalho também paralisaram suas atividades. De acordo com o comunicado publicado pelo TJES, o presidente da Corte, desembargador Annibal de Rezende Lima, autorizou o diretor dos fóruns das demais comarcas a suspender duas atividades, considerando as circunstâncias locais. O pedido de suspensão foi reforçado pela Ordem dos Advogados do Brasil no Estado (OAB-ES), que também suspendeu parcialmente as atividades na seccional. Somente o gabinete da Presidência irá funcionar, enquanto os demais setores estarão fechados.
TJES DEFERE PEDIDO DO ESTADO CONTRA O MOVIMENTO DE MILITARES NO ESPÍRITO SANTO
O desembargador do Tribunal de Justiça do Espírito Santo (TJES) Robson Luiz Albanez deferiu o pedido de tutela antecipada ajuizado pelo Governo do Estado do Espírito Santo, onde o requerente pedia a decretação da ilegalidade do movimento dos militares do Espírito Santo, e determinou que as instituições requeridas na ação, sob pena de multa diária de R$ 100 mil, se abstenham de realizar qualquer tipo de paralisação dos serviços prestados à sociedade na área de segurança pública. O magistrado ainda determinou que os piquetes montados nas sedes da Polícia Militar e do Corpo de Bombeiros sejam desfeitos.
O valor da multa por descumprimento da determinação da Justiça deverá ser pago pelas instituições envolvidas nas paralisações, de maneira individual.
Ao decidir pelo deferimento da tutela antecipada, o desembargador buscou amparo na Constituição, onde fica vedado qualquer tipo de paralisação por parte de militares, uma vez que seus serviços são indispensáveis para a sociedade. Ainda de acordo com o magistrado, a ausência de policiamento coloca em risco a segurança coletiva.
O risco ao qual todos os capixabas estão expostos por conta da falta de policiais nas ruas dos municípios, foi outro fator enfatizado pelo desembargador para dar provimento ao pedido do Estado. Além disso, o magistrado destaca, ainda, o caos instaurado após a paralisação dos serviços da Polícia Militar do Estado (PMES), sendo, inclusive, amplamente divulgado na mídia local e nacional.
São citadas na ação as seguintes associações: Associação de Cabos e Soldados da Polícia Militar do Estado do Espírito Santo, Associação dos Subtenentes e Sargentos da Polícia e Bombeiro Militar do Espírito Santo, Associação dos Bombeiros Militares do Espírito Santo, Associação dos Oficiais Militares do Espírito Santo e Associação dos Militares da Reserva, reformados, da ativa da Polícia Militar, do Corpo de Bombeiros Militar e Pensionistas de Militares do Estado do Espírito Santo.
