Samarco suspende contratos de trabalhadores mais uma vez

A mineradora Samarco deu início nesta quinta (1º) a mais um período de layoff, suspendendo o contrato de trabalho de cerca de 800 funcionários por dois meses. O prazo pode ser ainda prorrogado por mais três meses. A medida foi tomada, segundo a empresa, por ser a melhor solução para preservar os postos de trabalho no momento, já que não há certezas em relação à data de retomada das operações.

As atividades da mineradora estão suspensas em decorrência da tragédia de Mariana (MG), que ocorreu em novembro de 2015, quando uma de suas barragens se rompeu e liberou no ambiente mais de 60 milhões de metros cúbicos de rejeitos. Houve devastação da vegetação nativa, poluição da Bacia do Rio Doce e destruição de comunidades. Dezenove pessoas morreram. O episódio é considerado a maior tragédia ambiental do país.

No layoff, o contrato de trabalho é suspenso, assim como o pagamento do salário. No entanto, a empresa tem que oferecer aos funcionários afastados treinamentos de requalificação, e os empregados têm direito a receber uma bolsa paga pelo Fundo de Amparo ao Trabalhador. Para que não haja prejuízos aos trabalhadores, a Samarco propôs uma ajuda de custo complementar até atingir o valor do salário líquido de cada um e garantiu que irá manter os benefícios atuais como o plano de saúde e o vale alimentação.

A medida foi negociada com os trabalhadores, que a aprovaram em assembleias organizadas pelo Sindicato Metabase de Mariana e pelo Sindicato dos Metalúrgicos do Estado do Espírito Santo. Atualmente, a Samarco tem cerca de 1,8 mil empregados divididos entre suas duas unidades operacionais: uma na cidade mineira de Mariana e outra em Anchieta, no Espírito Santo.

Este será o terceiro período de layoff concedido pela Samarco desde a tragédia. Outras medidas já adotadas pela mineradora foram duas licenças remuneradas e um período de férias coletivas. Diferente do layoff, a licença remunerada consiste na permissão dada ao empregado para ausentar-se do trabalho temporariamente. Ele continua a receber normalmente o seu salário. Nas férias coletivas, a empresa opta por conceder o direito às férias de forma simultânea a todos ou a uma parte dos funcionários.

Em julho do ano passado, também foi colocada em prática um Programa de Demissão Voluntária (PDV). No total, 925 empregados aderiram ao PDV e 153 foram demitidos por iniciativa da mineradora com direito às vantagens oferecidas no programa.

Retomada

A Samarco esperava retomar suas atividades no segundo semestre desse ano. No entanto, um impasse com a prefeitura de Santa Bárbara (MG) atrasou o processo e atualmente a mineradora não estipula uma data para reiniciar suas operações. O município é o único que ainda não entregou a carta de conformidade. O documento é um pré-requisito para que se possa solicitar a liberação das licenças ambientais suspensas à Secretaria de Meio Ambiente e Desenvolvimento Sustentável de Minas Gerais.

A carta de conformidade deve atestar que as estruturas da empresa estão de acordo com a legislação municipal de uso e ocupação do solo. Ela deve ser entregue pelas prefeituras das cidades mineiras envolvidas na cadeia de produção. Embora não exista efetiva produção da Samarco em Santa Bárbara, a empresa faz captação e bombeamento de água em um de seus distritos. As estruturas que existem no local não foram afetadas pela tragédia.

O impasse ocorre porque a prefeitura do município considera que a retomada das atividades provocaria impactos no meio ambiente. Dessa forma, passou a cobrar ações de mitigação por parte da mineradora e esperava negociar contrapartidas. Uma das possibilidades que chegou a ser cogitada foi um projeto voltado para o tratamento do esgoto.

No entanto, a mineradora obteve uma decisão favorável do Tribunal de Justiça de Minas Gerais (TJMG). Há pouco mais de duas semanas, o desembargador Raimundo Messias Júnior concordou com a argumentação da empresa de que a avaliação de impactos ambientais é de responsabilidade do governo estadual, cabendo ao município tão somente avaliar a conformidade em relação à sua legislação de uso e ocupação do solo.

O magistrado determinou que a prefeitura de Santa Bárbara dissesse em 10 dias se a estrutura que existe no município está de acordo com a lei municipal. Santa Bárbara informou que foi notificada da decisão no dia 23 de maio e que apresentaria a sua avaliação até o dia 6 de junho.

Na semana passada, durante uma audiência pública realizada em Belo Horizonte, os prefeitos de Mariana e de Anchieta manifestaram seu descontentamento com o comportamento da prefeitura de Santa Bárbara. As duas cidades são as principais prejudicadas pela paralisação da Samarco e vivem uma crise econômica, já que suas receitas dependem em grande parte da produção da mineradora. No município mineiro, ocorre a extração e o beneficiamento do minério de ferro. Já na cidade capixaba, estão quatro usinas de pelotização e um porto.
