Eleitor que não votou nem justificou no 1º turno pode votar normalmente no 2º

eleicoes_2016Mesmo quem não compareceu à seção eleitoral no primeiro turno das eleições municipais, no dia 2 de outubro, e nem conseguiu justificar a sua ausência às urnas, poderá votar normalmente nas eleições deste domingo (30), para escolher prefeitos e vice-prefeitos. O segundo turno será realizado em 57 cidades de 20 estados, de acordo com dados divulgados pelo Tribunal Superior Eleitoral (TSE).

Caso esteja fora do seu domicílio eleitoral no dia 30, o eleitor poderá justificar o voto em qualquer local destinado ao recebimento de justificativa, apresentando o Requerimento de Justificativa Eleitoral, distribuído no local e que também pode ser impresso no portal do TSE na internet. O eleitor terá de preencher o formulário e assiná-lo na presença de um mesário.

Além do requerimento preenchido o número do seu título, o eleitor terá de apresentar um documento de identificação oficial com foto, como carteiras de identidade, de habilitação ou de trabalho, passaporte, identidade funcional ou qualquer outro documento de valor legal.

Se o eleitor não puder apresentar a justificativa no dia da votação, deverá fazê-lo até o dia 29 de dezembro (60 dias após o segundo turno). E quem não votou nem justificou a ausência no primeiro turno tem até o dia 1º de dezembro para fazê-lo. Nessas situações, o Requerimento de Justificativa  Eleitoral poderá ser entregue em qualquer cartório ou posto de atendimento eleitoral ou encaminhado, via postal, ao cartório da zona eleitoral onde ele for inscrito.

Os eleitores que estiverem no exterior no dia da eleição terão até 30 dias contados da data do retorno ao Brasil para apresentar a justificativa à Justiça Eleitoral, podendo entregá-la pessoalmente ou encaminhá-la pelos Correios. O requerimento deve ser apresentado – juntamente com cópia de documento brasileiro válido de identificação e com a prova do motivo alegado – ao respectivo cartório do município onde o eleitor vota.

Sanções

O eleitor que não votar e não apresentar justificativa ficará impedido de tirar passaporte, inscrever-se em concurso ou prova para cargo ou função pública, investir-se ou empossar-se neles e renovar matrícula em estabelecimento de ensino oficial ou fiscalizado pelo governo.

Já o eleitor que não votar em três eleições consecutivas, não justificar sua ausência e não quitar a multa devida terá sua inscrição cancelada. Para efeito de cancelamento, cada turno é considerado como uma eleição.

Acessibilidade

No dia da votação, o eleitor não poderá entrar acompanhado na cabina, para preservar o sigilo do voto garantido pela Constituição. No entanto, pessoas que tenham alguma restrição de mobilidade ou dificuldade de locomoção têm o direito de ser auxiliado por alguém de sua confiança na hora de votar.

As urnas eletrônicas são identificadas com uma marca em relevo na tecla 5 para orientar o eleitor cego com relação às demais teclas e um sistema de áudio, que é automaticamente habilitado para o eleitor que já se identificou à Justiça Eleitoral como deficiente visual.
