Consumidor não é obrigado a contratar qualquer pacote de serviços e pode ter conta em qualquer banco sem precisar pagar taxas
Quem de nós não ficou surpreso ao verificar no extrato bancário o valor da taxa de serviços? Pensando nisto e baseado nas inúmeras reclamações recebidas pelo Procon referente a instituições bancárias, o órgão orienta os consumidores sobre seus direitos. As normas estão estabelecidas na Resolução 3919 do Banco Central e garantem vários serviços gratuitos ao correntista.
Em Vila Velha, no ano passado, percebeu-se um aumento de cerca de 50% na procura de consumidores pela intermediação do Procon para o tema “repactuação de dívidas”. De acordo com a coordenadora do Procon, Elba Luchi, em muitos desses casos os consumidores informam que nunca solicitaram limite de crédito em conta (cheque especial) e que não sabem lidar com o mesmo, desconhecendo inclusive a taxa de juros aplicada. “Muitos acreditam que as dívidas com as instituições bancárias são sempre em decorrência de empréstimos ou financiamentos, quando a realidade nos mostra que muitos possuem dívidas e se “enrolam” em razão das altas taxas administrativas vinculadas à conta, bem como à utilização de cheque especial ou limite especial sem que dele conheçam, sem que saibam controlar, já que tais instituições tendem a oferecer os serviços mais onerosos sob o prisma da “melhor qualidade”.
De acordo com a Resolução 3919 do Banco Central o correntista tem direito aos seguintes serviços:
* um cartão com função débito e poderá realizar até quatro saques por mês, inclusive, por meio de cheque;
* tem direito até duas transferências por mês entre contas da mesma instituição;
* tem direito a dois extratos por mês contendo a movimentação dos últimos 30 dias por meio de guichê de caixa e/ou terminal de autoatendimento.
*Consultas livres pela internet.
* Direito de receber até 28 de fevereiro de cada ano o extrato consolidado discriminando mês a mês os valores das tarifas cobradas no ano anterior;
* dez folhas de cheques por mês, desde que o cliente reúna os requisitos necessários à utilização de cheques, conforme a regulamentação em vigor e condições pactuadas;
* compensação de cheques e prestação de qualquer serviço por meios eletrônicos, no caso de contas cujos contratos prevejam utilizar exclusivamente meios eletrônicos.
Elba diz ainda que o consumidor precisa prestar atenção ao uso restrito destes itens evitando o máximo o uso de cheque especial ou qualquer outra linha de crédito, pois os juros normalmente são elevados.
Caso o consumidor verifique algum problema com sua conta, como uma cobrança indevida, ele deverá fazer uma reclamação junto ao Serviço de Atendimento ao Consumidor (SAC) de seu banco. Nesse caso, o consumidor terá direito a devolução em dobro do valor pago indevidamente. O Decreto 6.523/2008 determina que a empresa solucione a demanda em até cinco dias úteis.
