Mulher condenada em R$ 5 mil após ofender vizinha

Após ofender a  honra e a cor da pele da vizinha, uma moradora de São Mateus foi condenada a indeniza-la em R$ 5 mil pelos danos morais causados.

Nos autos, a ofendida afirma que a ré teria entrado em sua casa durante a madrugada e furtado seu pé de pimenta. Ao discutir com a requerida, teria escutado ofensas contra sua cor, e a acusação de que estaria realizando programas dentro de carros, no meio da rua.

A autora é microempresária que atende em seu domicílio, tendo sido a situação presenciada por uma de suas clientes, levando a requerente a pedir indenização por danos morais.

Para o juiz da 2º Vara Cível de São Mateus, as duas testemunhas apresentadas pela requerente confirmaram a versão da autora, sendo o suficiente para comprovar as ofensas, e levar o magistrado a decidir pela indenização por danos morais.

O juiz afirma em sua decisão “que os comentários proferidos pela requerida não devem integrar a vida em sociedade, e no presente caso, ultrapassaram a seara do mero aborrecimento cotidiano, o que justifica a intervenção judicial, razão pela qual vislumbro, portanto, a existência de dano moral”.
