Caso Mariana: MPF recorre de decisão que homologou acordo

Embargos declaratórios elencam diversos fundamentos para a reforma da decisão

O Ministério Público Federal (MPF) impugnou, por meio de embargos declaratórios, a homologação judicial do acordo firmado nos autos de ação civil pública proposta pela União e Estados de Minas Gerais e do Espírito Santo contra as empresas Samarco, Vale e BHP Billiton.

O MPF pede a suspensão dos efeitos da decisão para que sejam sanadas suas omissões e contradições, ou, não sendo possível tal correção, a nulidade do acordo.

A Ação Civil Pública nº 69758-61.2015.4.3400, objeto da controvérsia, foi proposta em 30 de novembro do ano passado pela Advocacia-Geral da União e pelos órgãos de representação dos estados de Minas e do Espírito Santo contra as empresas responsáveis pelo desastre socioambiental decorrente da ruptura da barragem de Fundão, em Mariana/MG.

Considerada a pior tragédia socioambiental da história do país, o rompimento de Fundão causou 19 mortes e riscou do mapa o distrito de Bento Rodrigues, desalojando inúmeras pessoas ao longo do curso dos rios atingidos pelos rejeitos. A lama que desceu da barragem seguiu o curso do rio Doce, chegando ao oceano Atlântico, no Espírito Santo. A força e o volume dos rejeitos destruiu estruturas públicas e privadas, áreas agrícolas e pastoris, áreas de preservação permanente e a biodiversidade aquática e terrestre, além de assorear cursos d´água e interromper o abastecimento de água de inúmeras populações dos estados mineiro e capixaba. De tão graves, os danos socioambientais e econômicos ainda não puderam ser completamente mensurados, até porque eles continuam a ocorrer.

Ajuizada em Brasília, a ação foi posteriormente encaminhada à 12ª Vara da Justiça Federal em Belo Horizonte, em virtude de competência firmada pelo Superior Tribunal de Justiça (STJ) em favor do juízo federal mineiro. No dia 18 de dezembro de 2015, o juízo competente deferiu vários pedidos liminares constantes da ação, decisão contra a qual foram interpostos recursos, chamados agravos de instrumento, pelas empresas rés.

Pendentes de julgamento tais recursos perante o Tribunal Regional Federal da 1ª Região (TRF-1), os autores da ação e as empresas mobilizaram-se na formatação de um acordo que, segundo o MPF, não poderia prosperar, porque, além de não garantir a reparação integral do dano, a proposta não  tutela de forma integral, adequada e suficiente os direitos coletivos afetados, diante da ausência de participação efetiva dos atingidos nas negociações e da limitação de aportes de recursos por parte das empresas para a adoção de medidas reparatórias e compensatórias.

A despeito dos diversos e tempestivos questionamentos feitos pelo Ministério Público Federal por meio da Força-Tarefa constituída para atuar no caso, no último dia 5 de maio, o acordo foi homologado pelo Núcleo de Conciliação do TRF-1, suspendendo, na prática, a tramitação da ação originária, que seguia seu curso perante a 12ª Vara Federal em Belo Horizonte.

Para o MPF, a homologação tem de ser revista, porque a decisão viola competência do juízo de primeiro grau, além de impedir a participação de outros legitimados, como a Defensoria Pública da União (DPU) e a Defensoria Pública do Estado do Espírito Santo (DPE/ES), que já haviam pedido para ingressar na ação originária como litisconsortes ativos (coautores).

“Há pressupostos que não foram observados para o aperfeiçoamento do acordo, entre eles a ausência de participação popular na sua formulação e a falta de legitimidade dos entes federativos para dispor a respeito dos direitos das vítimas”, afirma o procurador regional da República Felício Pontes Jr., autor dos embargos declaratórios.

Segundo ele, “em que pese o esforço do Núcleo Central de Conciliação do TRF1, não é admissível que as partes requeiram a homologação de acordo perante o juízo competente, que é a 12ª Vara da Seção Judiciária de Minas Gerais, e, enquanto esse procura ouvir todos os legitimamente envolvidos, as mesmas partes formulem pedido idêntico em segunda instância, em clara usurpação de competência do Juízo de piso”.

Além disso, resoluções do Conselho Nacional de Justiça (CNJ) e do próprio TRF-1 determinam que os Núcleos de Conciliação devem seguir, em seu âmbito de atuação, o princípio do juiz natural, o que somente permitiria a conciliação pelo respectivo núcleo da Seção Judiciária de Minas Gerais, onde tramita a ação, e não pelo Núcleo de Conciliação da segunda instância.

Outro ponto destacado é a ausência de intimação prévia do MPF, com carga ou remessa dos autos, antes da realização da audiência de conciliação. “O vício acima acarreta a nulidade da homologação, havendo claro prejuízo à sociedade, uma vez que não foram apreciadas as diversas razões a serem levantadas pelo Ministério Público em desfavor do acordo celebrado”, aponta o recurso.

Populações atingidas – O MPF elenca ainda o descontentamento da sociedade atingida em relação ao acordo celebrado. Além do Movimento dos Atingidos por Barragens (MAB), a própria presidência da Comissão de Direitos Humanos e Minorias da Câmara dos Deputados também manifestou repúdio ao conteúdo do acordo e descontentamento quanto à forma como foi conduzida a homologação.

O procurador regional Felício Pontes Jr. também alerta  para a inclusão de cláusula no acordo que põe fim à ação civil pública que tramita na 1ª instância, violando a necessidade de busca de sinergia entre todos os envolvidos para a proteção dos direitos coletivos. “Não há até o presente momento diagnóstico conclusivo sobre os impactos do desastre no meio físico, biótico e socioeconômico. O que há são laudos preliminares, elaborados tanto por parte do Poder Público quanto por parte das empresas. Por isso, podemos considerar que o acordo fere o princípio do poluidor-pagador, que impõe aos agentes poluidores a obrigação de reparação integral dos danos, assim como a de internalizar os custos sociais negativos de sua atividade econômica. Além disso, os valores já gastos em 2016 não devem ser abatidos do pagamento de R$ 2 bilhões determinados anteriormente pela Justiça Federal”.

O MPF esclarece que é prejudicial a limitação de despesas para a adoção de medidas compensatórias, no valor de R$ 4,1 bilhões, já que houve solicitação às rés da execução de uma série de políticas públicas não implementadas, como, por exemplo, a construção de estações de tratamento de esgoto e centros de tratamento de resíduos sólidos. “Há falta de clareza técnica do acordo até mesmo para se identificar o que seriam medidas reparatórias e o que seriam compensatórias”, diz o recurso.

O procurador regional afirma que “se os valores compensatórios acordados com o Poder Público tivessem sido interpretados com garantia mínima, não haveria impugnação do acordo”. Em relação à Vale e à BHP, defende que haja a responsabilização solidária dos poluidores. Critica também o Poder Público ao não assumir nenhuma responsabilidade para a garantia do sucesso dos programas socioeconômicos e socioambientais a serem implementados pelas rés, prevendo “prazos extremamente estendidos para sua implementação, sem que haja respaldo científico que indique a necessidade de tamanha dilação temporal”.

Quanto ao Comitê Interfederativo regulamentado no acordo, o MPF entende que ele é inconstitucional, pois constitui órgão público interfederativo “disfarçado”, criado em violação ao princípio da reserva legal e da separação dos poderes.

Por fim, o MPF sustenta que, apesar de constar pedido expresso na ação originária de condenação das empresas à indenização por danos extrapatrimoniais coletivos, o acordo não traz nenhuma linha sobre o tema e, inexplicavelmente, trata de forma exaustiva o evento e suas consequências socioambientais e socioeconômicas, com a suspensão do processo até o cumprimento das obrigações e extinção dos agravos de instrumentos então pendentes.

O MPF aponta ainda contradições e omissões entre o que foi consignado em ata e o conteúdo dos atos relativos à atuação do Ministério Público e solicita a juntada aos autos das notas taquigráficas da audiência.
