O Tribunal Superior Eleitoral (TSE) deve concluir nesta sexta (9) o julgamento da ação em que o PSDB pede a cassação da chapa Dilma-Temer, vencedora das eleições de 2014. A sessão está marcada para começar às 9h, com a finalização do voto do relator, ministro Herman Benjamin. Ficou acertado que, após o voto do relator, cada ministro terá cerca de 20 minutos para proferir o voto.
Na primeira parte de seu voto, Herman Benjamin afirmou que a campanha da chapa praticou abuso de poder político e econômico por ter recebido propina como doação eleitoral. Ele ponderou, no entanto, que os crimes atribuídos à chapa vencedora também foram praticados por outros partidos.
Na sessão desta quinta (8), a Corte também debateu o pedido feito pelos advogados da chapa para retirar do processo as delações de executivos da Odebrecht. Para os advogados, fatos que não constam na petição inicial, protocolada pelo PSDB em 2014, não podem ser alvo do julgamento. Apesar da manifestação do relator contra a retirada, quatro dos sete ministros indicaram que devem votar a favor das defesas, mas a deliberação deve ser confirmada somente hoje.
Após o relator, deverão votar os ministros Napoleão Nunes Maia, Admar Gonzaga, Tarcisio Vieira, Rosa Weber, Luiz Fux, e o presidente do tribunal, Gilmar Mendes.

Depois do resultado das eleições de 2014, o PSDB entrou com a ação, e o TSE começou a julgar suspeitas de irregularidade nos repasses a gráficas que prestaram serviços à campanha eleitoral de Dilma e Temer. Recentemente, o relator Herman Benjamin decidiu incluir no processo o depoimento dos delatores ligados à empreiteira Odebrecht investigados na Operação Lava Jato. Os delatores relataram que fizeram repasses ilegais para a campanha presidencial.
Em dezembro de 2014, as contas da campanha da então presidente Dilma Rousseff e de seu vice, Michel Temer, foram aprovadas com ressalvas e por unanimidade no TSE. No entanto, o processo foi reaberto porque o PSDB questionou a aprovação. Segundo entendimento do TSE, a prestação contábil da presidente e do vice-presidente é julgada em conjunto.

A campanha de Dilma Rousseff nega qualquer irregularidade e sustenta que todo o processo de contratação das empresas e de distribuição dos produtos foi documentado e monitorado. A defesa do presidente Michel Temer diz que a campanha eleitoral do PMDB não tem relação com os pagamentos suspeitos. De acordo com os advogados, não se tem conhecimento de qualquer irregularidade no pagamento dos serviços.
