O Supremo Tribunal Federal (STF) rejeitou, por sete votos a quatro, a desaposentação – a possibilidade de o aposentado pedir a revisão do benefício por ter voltado a trabalhar e a contribuir para a Previdência Social.
Votaram contra o recálculo da aposentadoria os ministros Dias Toffoli, Teori Zavascki, Edson Fachin, Luiz Fux, Gilmar Mendes, Celso de Mello, e a presidente, Cármen Lúcia. A favor votaram Marco Aurélio, Luís Roberto Barroso, Rosa Weber e Ricardo Lewandowski.
A legalidade do benefício estava em julgamento na Corte há dois anos e sofreu sucessivos pedidos de vista. Mais de 180 mil processos estavam parados em todo o país aguardando a decisão do Supremo.
A validade da desaposentação foi decidida após um aposentado pedir ao Instituto Nacional do Seguro Social (INSS) a interrupção do pagamento da atual aposentadoria por tempo de serviço e a concessão de um novo benefício por tempo de contribuição, com base nos pagamentos que voltou a fazer quando retornou ao trabalho.
Em parecer enviado hoje (26) ao Supremo, a Advocacia-Geral da União (AGU) defendeu que para a concessão da desaposentação seria necessário que o segurado devolva todos os valores recebidos durante a aposentadoria.
A AGU entende que a revisão sem a devolução dos valores contraria a Constituição Federal, que estabelece o “caráter contributivo da Previdência Social e a necessidade de preservação do equilíbrio entre suas receitas e despesas” do INSS.
Durante o julgamento, o ministro Luís Roberto Barroso reconheceu a desaposentação. Ele entendeu que o pedido de revisão deverá levar em conta o tempo e o valor de todo o período de contribuição, englobando as fases anteriores e posteriores da primeira aposentadoria.
Em contrapartida, a idade do contribuinte e a sua expectativa de vida serão contadas de acordo com o primeiro benefício, a menos que o aposentado decida devolver o valor que já recebeu.
A aposentadoria é calculada de acordo com a média da contribuição. O valor é multiplicado pelo fator previdenciário, cálculo que leva em conta o tempo e valor da contribuição, a idade e expectativa de vida.
Para o Instituto Nacional do Seguro Social (INSS), o segurado deve devolver todos os valores que foram pagos, em parcela única, para ter direito ao recálculo do benefício. De acordo com a Advocacia-Geral da União (AGU), uma eventual decisão desfavorável à Previdência terá impacto de R$ 7,7 bilhões por ano nos cofres do INSS.
